1. PARTIES
1.1. Seller (Agency)

1.2. Buyer (Consumer)
The person whose name, surname, and contact information are stated in the reservation form or tour registration document is defined as the "CONSUMER".
1.3. Participants
"Participants" refer to the persons whose identity details are recorded on the Reservation Document / Tour Registration Form / Voucher, and who will benefit from the cruise service purchased by the CONSUMER.
The CONSUMER is exclusively responsible for:
- providing accurate and complete information regarding the participants,
- informing the participants about this Contract and its annexes,
- ensuring that the participants act in accordance with the provisions of the Contract.
2. SUBJECT OF THE CONTRACT
This Contract regulates the rights and obligations of the parties regarding the sale and performance of the cruise services specified in the Tour Registration Form, Voucher (Package Tour Contract), Cruise Program / Brochure, Reservation Document, and Receipt.
The aforementioned documents are annexes and an integral part of this Contract.
3. GENERAL PROVISIONS
The CONSUMER acknowledges and declares that they have examined, read, and understood all brochures, websites, and information documents containing all details regarding the scope, content, price, payment conditions, and performance of the cruise tour subject to the contract.
For international cruise tours, the CONSUMER is obliged to carry a passport valid for at least six (6) months from the end date of the tour, with at least two blank pages suitable for entry-exit stamps, as well as mandatory visas and identification documents in full.
The AGENCY is not responsible for any consequences arising from the failure to fulfill these obligations.
Any responsibility arising from the baggage and its contents belongs entirely to the CONSUMER.
The AGENCY cannot be held responsible for lost, stolen, or damaged items during the cruise.
The CONSUMER is obliged to comply with all rules and instructions given by the ship captain, port authorities, guides, and the AGENCY.
The CONSUMER is directly and exclusively responsible for any damages caused to third parties due to behaviors contrary to these obligations.
The CONSUMER agrees to personally cover the cost of all personal expenses and extra services that are outside the scope of the purchased package tour.
4. CRUISE-SPECIFIC PROVISIONS
4.1. Program and Route Changes
The ports to be visited by the ship, the order of the ports, the duration of stays, and the route may be altered, or some ports may be bypassed due to sea conditions, adverse weather, decisions of port authorities, security requirements, technical necessities, or force majeure events. These changes are not considered a defective performance of the package tour and do not entitle the CONSUMER to any refund or compensation.
4.2. Promotional Materials
The program information contained in brochures, websites, and other promotional materials is provided for information purposes only and is not binding. The final program is determined by the ship captain and the ship operator based on safe navigation principles.
4.3. Responsibility of the Ship Operator
Cruise services are provided by the ship operator, and the AGENCY acts solely as an intermediary. The AGENCY cannot be held responsible for changes and disruptions resulting from the operational decisions, technical failures, captain's discretion, and port practices of the ship operator.
5. SERVICE FEE AND PAYMENT
The services included in the cruise package tour price are explicitly stated in the Voucher. Services outside the scope of the Voucher are subject to extra charges.
Unless otherwise agreed, full payment of the cruise tour fee is mandatory at the time of reservation.
Early reservations and promotional sales are subject to special terms, and cancellation and modification conditions may differ for these products. The applicable conditions are notified to the CONSUMER during the purchase.
6. CANCELLATION, WITHDRAWAL, AND AMENDMENT CONDITIONS
Date change requests by the CONSUMER are evaluated as a termination of the contract, and cancellation conditions apply.
Cancellation and refund conditions for cruise tours are subject to the special terms of the ship operator, airline, and other service providers. Any deductions that may arise from these conditions are accepted by the CONSUMER in advance.
If the CONSUMER misses the start of the tour or fails to provide a written notification of participation, the AGENCY reserves the right to cancel all reservations; in this case, no refund will be made.
Product-based refund/cancellation details are based on the Reservation Document / Voucher and the current terms of the respective service providers.
7. FLIGHT SERVICES
In cases where outbound and return flights are issued under the same reservation number, the failure of the CONSUMER to use the outbound flight results in the automatic cancellation of the return flight in accordance with the rules of the respective airline. The AGENCY is not responsible for this situation.
8. FORCE MAJEURE
Natural disasters, war, terrorism, epidemics, quarantine practices, decisions of authorized authorities, adverse weather conditions, transport restrictions, and similar events beyond the control of the AGENCY are considered force majeure. In cases of force majeure, no liability arises for the AGENCY.
9. PROTECTION OF PERSONAL DATA
Within the scope of the Law No. 6698 on the Protection of Personal Data, personal data belonging to the CONSUMER and participants are processed solely for the purpose of the establishment and execution of the contract. 10. AUTHORIZED COURT AND APPLICABLE LAW
Turkish Law shall apply to disputes arising from this Contract. The authorized judicial authorities are the Istanbul Anadolu Courts and Execution Offices.
11. EFFECTIVENESS
This Contract enters into force upon being approved electronically or signed physically by the CONSUMER. It has been read, understood, and accepted by the parties.
