Distance Sales Agreement
1. PARTIES
This Distance Sales Agreement (“Agreement”) is concluded between Selam Teknoloji Turizm Yatırım A.Ş. (“AGENCY”), as one party, and the consumer who purchases the cruise (ship) tour services offered for sale by the AGENCY (“CONSUMER”), as the other party.

1.2 PARTICIPANTS
Within the scope of this Agreement, “Participants” are the persons who will benefit from the purchased cruise (ship) tour service and whose name-surname and other identity details are stated on the Reservation Document / Tour Registration Form / Voucher. Participants are identified by the information stated in these documents, which constitute an integral part of this Agreement.
The CONSUMER is responsible for providing accurate and complete information for all Participants, informing the Participants about this Agreement and its annexes, and ensuring that the Participants comply with the provisions of this Agreement.
2. SUBJECT
This Agreement governs the rights and obligations regarding the sale and performance of the cruise (ship) tour services specified in the Tour Registration Form, Voucher (Package Tour Agreement), Cruise Program/Brochure, Reservation Document, and Receipt, which form an integral part of this Agreement.
3. GENERAL PROVISIONS
- The CONSUMER acknowledges that they have read and understood the brochure, website, and information documents containing the scope, content, price, payment method, and all performance details of the cruise tour subject to this Agreement.
- For international cruise tours, the CONSUMER must carry a passport valid for at least six (6) months from the tour end date, with at least two (2) blank pages suitable for entry/exit stamps, as well as all required visas and identity documents. The AGENCY shall not be liable for any consequences arising from non-compliance.
- If the service cannot be used due to reasons attributable to the CONSUMER (passport/visa issues, tax debt, judicial/administrative bans, exit restrictions by authorities, or refusal of entry by foreign authorities), the AGENCY bears no legal or criminal liability.
- All responsibility for baggage and its contents belongs to the CONSUMER. The AGENCY cannot be held responsible for items lost, stolen, or damaged during the cruise.
- The CONSUMER must comply with all rules and instructions communicated by the ship operator, captain, port authorities, guide, and the AGENCY, and shall be solely responsible for any damage to third parties’ life or property caused by non-compliance.
- The CONSUMER agrees to pay all personal expenses and additional service fees outside the purchased package tour.
4. CRUISE-SPECIFIC PROVISIONS
4.1 Program and Route Changes
Due to sea conditions, adverse weather, decisions of port authorities, security reasons, technical necessities, or force majeure, the ports of call, port order, duration of calls, and the cruise route may be changed, or some ports may be cancelled. Such circumstances shall not be deemed defective performance and shall not entitle the CONSUMER to a refund or compensation.
4.2 Promotional Materials
The cruise program stated in brochures, the website, and promotional materials is for information purposes and is not binding. The final program is determined by the ship’s captain and ship operator based on safe navigation principles.
4.3 Ship Operator Responsibility
Cruise services are provided by the ship operator, and the AGENCY acts only as an intermediary. The AGENCY cannot be held responsible for changes or disruptions arising from the ship operator’s operational decisions, technical failures, captain’s discretion, and port practices.
5. SERVICE FEE AND PAYMENT
- The cruise package tour price includes the services stated on the Voucher. Services not included are subject to additional charges.
- Unless otherwise stated, the full tour price must be paid at the time of reservation.
- Early booking and promotional sales are subject to special terms and may have different cancellation/change conditions.
6. CANCELLATION, WITHDRAWAL AND CHANGES
- Date change requests submitted by the CONSUMER are deemed termination and cancellation conditions shall apply.
- For cruise tours, cancellation and refund conditions depend on the special terms of the ship operator, airline, and service providers. Accordingly, the CONSUMER accepts any deductions that may arise in case of cancellation.
- If the CONSUMER misses the start of the tour or fails to provide written confirmation of participation, the AGENCY has the right to cancel all reservations and no refund will be issued.
7. FLIGHT SERVICES
In cases where outbound and return flights are issued under the same booking reference, if the CONSUMER does not use the outbound flight, the return flight is automatically cancelled under airline rules. The AGENCY is not responsible for this.
8. FORCE MAJEURE
Natural disasters, war, terrorism, epidemics/pandemics, quarantine, government decisions, adverse weather conditions, transportation restrictions, and similar events beyond the AGENCY’s control shall be deemed force majeure. In such cases, the AGENCY shall not be liable.
9. PROTECTION OF PERSONAL DATA
Under Turkish Law No. 6698 on the Protection of Personal Data, the CONSUMER’s personal data is processed for the purpose of performing this Agreement.
10. COMPETENT COURT
Turkish law shall apply to disputes arising from this Agreement, and Istanbul Anatolian Courts and Enforcement Offices shall have jurisdiction.
11. EFFECTIVE DATE
This Agreement has been read and understood by the parties and enters into force upon the CONSUMER’s approval. We wish you a pleasant trip in advance.
